End User Agreement


This End User Agreement ("Agreement") is a legal agreement between you ("End User," "you," or "your") and R. Luke Thompson, LLC ("Company," "we," "our," or "us") for the use of www.demo.dvlap.com (the "App"), or any subdivision thereof, provided through R. Luke Thompson, LLC's Software-as-a-Service ("SaaS") platform. By accessing or using the App, you agree to be bound by the terms and conditions of this Agreement.

1. Acceptance of Terms

By using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, you are not authorized to use the App.

2. Use of the App
  • Official Use Only: You agree that you are a sworn law enforcement officer or provider of victim services to victims of domestic violence and/or other violent crimes. You agree to use the App solely for its intended purpose as authorized by your employer, organization, or the Victim Service Provider (“Customer”) who provided you access to the App. You shall not use the App for personal, unauthorized, or illegal activities.
  • Confidentiality: You agree to maintain the confidentiality of all information you access or interact with via the App. This includes, but is not limited to, any data, proprietary information, intellectual property, and other confidential content ("Confidential Information") that you are exposed to during your use of the App. You agree not to share, disclose, or distribute any Confidential Information to third parties without explicit authorization from the Customer or the Company.
  • Account Access: You are responsible for maintaining the confidentiality of your login credentials and ensuring they are not shared or used by others. You agree to notify your organization or the Customer immediately if you suspect any unauthorized access to your account.
3. Prohibited Activities

You agree not to:

  • Engage in any activities that could damage, disable, overburden, or impair the App’s functionality.
  • Use the App for any unlawful, harmful, or unethical purposes, including but not limited to fraud, data scraping, unauthorized data collection, or infringement of intellectual property rights.
  • Attempt to reverse engineer, decompile, or otherwise manipulate the App’s code, features, or security mechanisms.
  • Share or distribute any content, software, or data obtained from the App in violation of this Agreement.

Any violation of these prohibitions may result in immediate suspension or termination of your access to the App and may lead to permanent banning from future use of the Service.

4. Misuse and Consequences
  • Violation of Terms: Any misuse of the App, including unauthorized access, disclosure of Confidential Information, or engaging in activities prohibited by this Agreement, will result in disciplinary action as determined by the Customer and the Company.
  • Permanent Ban: In the event of a serious violation or repeated misuse, you acknowledge and agree that the Company or the Customer may take action to permanently ban your access to the App. You will be notified in writing if such action is taken.
5. Data and Privacy
  • Your Data: Any data you submit through the App will be handled in a manner to facilitate the services of the App. You acknowledge and agree that the Company is the owner of your data, and the Company may process your data as part of providing the Service. No data collected by this App will be sold, shared or otherwise distributed to anyone outside of provision of services by the App and will never be used for solicitation or marketing purposes.
  • No Sharing of Data: You may not share any personal, sensitive, or confidential information that you access or interact with through the App, unless explicitly authorized to do so by the Customer or the Company.
6. Termination
  • By the Company or Customer: The Company or the Customer may terminate or suspend your access to the App at any time for violation of this Agreement or for any reason deemed necessary to protect the security and integrity of the App.
  • By You: If you no longer wish to use the App, you must cease all use of the App and notify the Customer or organization that granted you access.
7. No Warranty

The App is provided "as is" without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company makes no guarantees regarding the accuracy, availability, or reliability of the App.

8. Limitation of Liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of business, or any damages resulting from misuse of the App.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law principles.

10. Changes to the Agreement

The Company reserves the right to modify or update this Agreement at any time. You will be notified of any significant changes, and your continued use of the App after such changes are made constitutes your acceptance of the updated terms.
